XploreMe! App Terms of Use & General Conditions

Clause 1 – Introduction
1.1 These App Terms of Use & General Conditions (“Terms of Use”) govern the access to and use of the XploreMe! App (“App”) provided by INTEGRIA LP, 5 South Charlotte Street, Edinburgh, EH2 4AN, Scotland, United Kingdom, registered in Scotland under Company No. SL037740, operating under the brand XploreMe! (“XploreMe!”, “we”, “our”, or “us”).
1.2 By creating an account, accessing, or using the XploreMe! App, you (“User”) confirm that you have read, understood, and agree to be bound by these Terms of Use.
1.3 During initial registration, Users must actively confirm acceptance by checking the box:
“I have read and agree to the App Terms of Use.”
1.4 If you do not agree to these Terms, you must not use the App.
Clause 2 – Scope of the App
2.1 The XploreMe! App enables Users to access and play interactive outdoor experiences – referred to herein as “Hunts” or “Xplorations” – using unique digital access codes (“Codes”) purchased via the official website www.xplore-me.com or authorised partner platforms such as Tripadvisor.
2.2 Each Hunt / Xploration is a self-guided, location-based challenge involving puzzles, navigation tasks, and informational or creative content.
2.3 The App is designed for leisure purposes only. It is not intended for emergency navigation, commercial use, or any activity requiring professional supervision.
Clause 3 – Account Registration and Access
3.1 Registration requires a valid email address and password.
3.2 Users are responsible for maintaining the confidentiality of their login credentials.
3.3 Accounts are personal and may not be shared or transferred.
3.4 XploreMe! reserves the right to suspend or delete accounts in cases of misuse, fraudulent behaviour, or breach of these Terms.
Clause 4 – Use of Codes
4.1 Codes grant access to a specific Hunt / Xploration.
4.2 Codes are single-use, non-transferable, and expire as indicated at the time of purchase.
4.3 Access to Hunts / Xplorations is only possible with an active internet connection and GPS functionality.
4.4 The purchase and delivery of Codes are governed by the Website Terms & Conditions (Sales Terms), available at www.xplore-me.com/sales-terms.
Clause 5 – Technical Requirements
5.1 The App requires an up-to-date mobile operating system (Android or iOS) and a functioning data connection.
5.2 It is the User’s responsibility to ensure sufficient device battery, data volume, and GPS signal for the duration of the Hunt / Xploration.
5.3 XploreMe! does not guarantee uninterrupted operation or compatibility with all device models.
Clause 6 – User Conduct and Safety Obligations
6.1 By using the XploreMe! App, Users agree to behave responsibly and with full awareness of their surroundings at all times.
6.2 Users must:
(a) comply with all applicable laws, traffic regulations, and local rules;
(b) avoid private or restricted areas, construction zones, and unsafe environments;
(c) remain cautious when crossing roads and moving near vehicles or water;
(d) take appropriate safety precautions regarding weather, terrain, and daylight;
(e) wear suitable clothing and footwear for outdoor conditions;
(f) bring water, sun protection, and weather-appropriate gear;
(g) avoid contact with unknown plants or animals and refrain from consuming wild fruits or substances found outdoors;
(h) respect local culture, property, wildlife, and the natural environment;
(i) behave courteously toward local communities and other individuals encountered during the activity.
6.3 The App may provide general guidance or reminders regarding safety, but ultimate responsibility lies with the User.
6.4 Users must not engage in behaviour that endangers themselves, others, or property, or that disrupts public order.
Clause 7 – Participation at Own Risk
7.1 All participation in Hunts / Xplorations occurs at the User’s own risk.
7.2 XploreMe! assumes no responsibility for injuries, accidents, health issues, or damages arising from participation or environmental conditions.
7.3 Users are advised to assess their personal physical condition before beginning a Hunt / Xploration and to refrain from participation if they feel unwell or unfit.
7.4 No Hunt / Xploration requires Users to perform unsafe, illegal, or hazardous actions.
7.5 Users are encouraged to obtain personal accident or liability insurance where appropriate.
Clause 8 – Location Data and Privacy
8.1 The App may request access to location data to enable navigation and verify the User’s position during a Hunt / Xploration.
8.2 Location data are processed only for gameplay functionality and are not used for tracking outside the session.

Clause 9 – Intellectual Property
9.1 All intellectual property rights in the App, including software, design, text, images, and content, are owned by or licensed to INTEGRIA LP, operating under the brand XploreMe!.
9.2 Users may not copy, distribute, reverse-engineer, or exploit any part of the App or its content without prior written consent.
9.3 The term “XploreMe!” and all related marks and graphics are protected trademarks of INTEGRIA LP.
Clause 10 – Prohibited Activities
Users agree not to:
(a) interfere with or disrupt the App’s functionality or servers;
(b) use the App to collect or transmit unlawful or harmful content;
(c) impersonate other users or manipulate App data;
(d) bypass security features or attempt to access restricted parts of the App;
(e) reproduce or sell access to any part of the App or its content.
Clause 11 – Availability and Updates
11.1 The App is available 24/7, except during maintenance, updates, or force majeure.
11.2 XploreMe! may modify or suspend certain functions at any time to improve usability or comply with legal requirements.
11.3 Users should regularly update the App to ensure optimal functionality and data security.
Clause 12 – Liability Limitation
12.1 XploreMe! shall not be liable for any indirect, consequential, or incidental damages, including but not limited to loss of data, income, or enjoyment.
12.2 Liability for direct damages is limited to the amount paid for the corresponding Code.
12.3 XploreMe! does not guarantee that all locations or routes described are free of temporary risks such as weather, maintenance work, or public closures.
12.4 Nothing in these Terms excludes liability for death, personal injury, or fraud caused by the proven negligence of XploreMe!.
Clause 13 – Age Restriction
13.1 The XploreMe! App and its Hunts / Xplorations are intended for Users aged 18 years and above.
13.2 Minors under 18 may participate only under the supervision and responsibility of an adult.
Clause 14 – Amendments to These Terms
14.1 XploreMe! may revise these Terms of Use from time to time.
14.2 Users will be notified of changes within the App, and continued use after such notice constitutes acceptance of the updated Terms.
14.3 The latest version will always be accessible at www.xplore-me.com/app-terms.
Clause 15 – Governing Law and Jurisdiction
15.1 These Terms of Use shall be governed by and construed in accordance with the laws of Scotland.
15.2 The courts of Edinburgh, Scotland, shall have exclusive jurisdiction to resolve any dispute arising in connection with the App or these Terms of Use.
